Thumpy: Cybergun Gobbles Up Swiss Arms

Swiss Arms Cybergun

The acquisition binge continues, and you are wondering what is the focus of Cybergun with all these acquisition deals, with the recent foray into video game intellectual property arena, and now they're most signifcant deal so far, the acquisition of a real arms manufacturer, Swiss Arms which is more of a shares-swap deal. I wonder how the Swiss airsoft community would react to this deal. Thumpy reports:

Cybergun s’empare de Swiss Arms

Petit aparté aux frontières entre airsoft et real steel, pour signaler que Cybergun vient d’acheter Swiss Arms auprès de sa maison-mère SAN Swiss Arms AG – pour un montant non communiqué. La firme suisse est notamment à l’origine des emblématiques SG550, SG551 et SG552 qui équipent de nombreuses groupes de défense à travers le monde (GIGN français, Navy Seals américains, Grenadiers suisses, etc.). Le leader du tir de loisir français poursuit ainsi ses opérations de croissance à un niveau international, nous ne savons pas encore si cette opération débouchera vers une évolution de la gamme airsoft de Cybergun – d’autant que ce dernier disposait déjà d’accords de licence avec Swiss Arms.

King Arms : Thompson M1928 Chicago & M1A1 Military

King Arms vient d’ajouter à son catalogue deux nouvelles répliques de Thompson intégralement en faux bois et métal qui étaient jusque là revendues uniquement par Cybergun. Les version M1928 Chicago et la M1A1 Military seront donc disponibles très prochainement sous la marque KA, à un prix inconnu.

Smith & Wesson attaque Cybergun en justice

Décidément pas une semaine ne passe sans que Cybergun ne fasse parler de lui ! En effet la compagnie d’arme à feu américaine Smith & Wesson a déposé le 17 Juin dernier une plainte au tribunal d’instance d’Arizona envers le revendeur français pour violation de marque déposée et concurrence déloyale.



Petit rappel des faits, en 2005 S&W a conclu un accord de licence avec Cybergun, donnant à ce dernier le droit exclusif d’utiliser la marque sur les répliques airsoft, ainsi que sur des cibles et paquets de billes. Cet accord a par la suite été étendu aux articles publicitaires et promotionnels, mais Cybergun se devait toujours d’obtenir l’autorisation expresse de S&W pour rétrocéder ces droits à des tierces parties.


En février 2009, la firme américaine aurait alerté Cybergun que Palco Sports, un des distributeurs des produits Cybergun, utiliserait des logos S&W dans son catalogue 2009 sans son approbation préalable – ce qui représente une violation de leur accord de licence. Malgré cela, Cybergun aurait permis à nouveau à Palco Sports d’utiliser ces mêmes logos dans le catalogue 2010, toujours sans l’autorisation de l’armurier. Ce dernier a été informé de la violation le 31 Mars 2010, et face à ce constat a résilié le contrat de licence et toutes les dispositions connexes.


Par la suite, en dépit de la résiliation de la licence par la firme américaine, Cybergun aurait continué à promouvoir et vendre des articles sous licence, en violation des droits sur les marques déposées. En conséquence, S&W poursuit Cybergun pour six chefs d’accusation, dont violation de marque déposée, concurrence déloyale, dilution de marque et rupture de contrat.

Smith & Wesson files Lawsuit against Cybergun, S.A.

Arizona based firearms manufacturer, Smith & Wesson has, on 17th June 2010 in the District of Arizona, filed a lawsuit against French airsoft retailer Cybergun, S.A., alleging Trademark Infringement, and Federal Unfair Competition related damages.


Smith & Wesson entered into a license agreement with Cybergun in 2005, giving Cybergun exclusive rights to use Smith & Wesson ‘Marks’ on licensed articles which included Airsoft guns, targets and ammunition, i.e. BBs. This license also extended to advertising and promotional material but express permission and approval had to be obtained from S&W for Cybergun to authorize third parties to use S&W ‘Marks’ in their promotional material.


ffirb3r5kfjaaxjxIn February 2009, Smith and Wesson allegedly notified Cybergun SA that third party retailer Palco Sports, a distributer for licensed Cybergun products, was allegedly using and displaying Smith & Wesson ‘Marks’ in it’s 2009 catalogue without express permission and approval from Smith & Wesson and that subsequently, Cybergun was in breach of their license agreement.


Subsequently, Cybergun allegedly permitted Palco Sports to once again use Smith & Wesson ‘Marks’ in the Palco Sports 2010 Sports Calender without prior written approval of Smith & Wesson and were notified of the breach on 31st March 2010. As a result of the failure of Cybergun to cure the numerous breaches, Smith & Wesson terminated the License agreement and all related provisions of the licence.


Despite the termination of the licence, Cybergun allegedly has continued to advertise and use the Marks with the Licensed Articles, and continues to sell those goods in violation of the License and in violation of federal trademark rights.


Subsequently, Smith & Wesson is suing for six counts including Federal Trademark Infringement, Federal Unfair Competition, Federal Dilution and Breach of Contract.

Cybergun Acquires US Distributor Spartan Imports

AirsoftNews France is reporting that French based airsoft retailer and trademark holder, Cybergun has acquired US based airsoft distributor Spartan Imports. Spartan Imports is well known by the US airsoft community as the US distributor for brands such as Classic Army, KWA and Magpul PTS among others. This is the second major acquisition this year for Cybergun, who announced last month that Taiwanese manufacturer Inokatsu has joined the Cybergun group.
